1. Scope of Application

These General Terms and Conditions (“Terms”) apply to all orders placed via the online shop of mesics GmbH, Im Mediapark 5, 50670 Cologne, Germany (hereinafter “mesics” or “we”). Any deviating terms and conditions of the customer shall not be recognized unless expressly agreed to by us in writing.

3. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. By clicking the button “Buy now”, the customer submits a binding offer to purchase. The contract is concluded once we confirm the order by email or dispatch the goods.

4. Prices and Shipping Costs

All prices are stated in euros and include statutory value-added tax (VAT). Additional shipping costs may apply and will be indicated during the ordering process. For deliveries outside Germany, additional costs (e.g. customs duties, taxes) may apply and must be borne by the customer.

5. Delivery and Availability

We deliver within Germany and to selected EU countries. Delivery times are specified in the online shop. If a product is unavailable, we will inform the customer without undue delay. Any payments already made will be refunded.

6. Payment

Payment is due immediately upon conclusion of the contract. Available payment methods are displayed in the online shop.

7. Retention of Title

The goods remain our property until full payment has been made.

8. Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days. Sealed medical products and individually customized products are excluded where legally permitted. The full withdrawal policy is provided separately in the online shop.

9. Warranty

The statutory warranty rights apply. For business customers, the limitation period for warranty claims is 12 months from the transfer of risk. Obvious defects must be reported within 7 days.

10. Liability

We are liable without limitation for intent and gross negligence. In cases of slight negligence, liability is limited to injury to life, body, or health and breach of essential contractual obligations, limited to the foreseeable, typical damage. Any further liability is excluded.

11. Medical Device Notices

Some of our products are medical devices. Customers must read the instructions for use carefully and use products only as intended. Consumables such as test strips are excluded from the right of withdrawal once the seal has been opened.

12. Data Protection

We process personal data exclusively in accordance with the GDPR. Further details are available in the privacy policy in the online shop.

13. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR). We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. Final Provisions

German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a business entity, the place of jurisdiction shall be Cologne.

Should individual provisions be invalid, the remaining provisions shall remain unaffected.
